In its decision of 19 June 2012, VII R43/11, the Federal Tax Court determined that imposing the tariff for the reconciliation of anti-terror lists to assign the status “authorised economic operator” is lawful pursuant to Section 32 of the Federal Data Protection Act (BDSG). 
The prohibition against entering into economic relationships with the persons included in the anti-terror lists is intended to economically isolate the persons in the lists and to ensure that they do not receive any funds – directly or indirectly – or other economic resources (see Regulation (EC) No. 2580/2001 and No. 881/2002). In order to accomplish this, companies have to control their cash flows and reconcile them with the anti-terror lists.
For our company, this means we have to reconcile all persons/customers with whom we conduct business with the corresponding anti-terror lists. Specifically we compare the first and last name, date of birth and citizenship.
